The Directorate of Legal Research at the Library of Congress: A Treasure Hidden Under a Bushel Basket

Despite harsh criticism of the citation of foreign law in American court decisions, the U.S. Supreme Court and the federal appellate courts solicit and are supplied with numerous studies surveying foreign law each year, according to the Library of Congress’s annual reports. The source of this scholarship is the talented staff of the Directorate of Legal Research (DLR), a little known but well-regarded and highly influential research department contained within the Library of Congress. DLR is a sister organization to the better-known Congressional Research Service (which itself has an American Law Division that produces legal studies on U.S. Law). The Directorate of Legal Research receives scant mention even among the legal research community.

While Senator Jon Kyl (R-Az), Justice Antonin Scalia and others have railed against the use of foreign law in U.S. Courts (the most heated objection is to the use of foreign law to interpret constitutional rights), U.S. courts and their jurists and clerks have in fact for many years relied upon the foreign law research reports produced by the DLR.

This curious and somewhat mystifying philosophical tension over the proper use of foreign law goes beyond insular fears, and may be better understood with an awareness that the federal judiciary already relies on foreign law from the DLR. Each year, the Library of Congress annual report describes how DLR supplies to the courts hundreds of research reports as well as the answers to specific legal inquiries posed by the courts.

The work of another Library of Congress think tank, the Federal Research Division (FRD) – which performs contract research for a variety of federal government agencies — will be discussed in a subsequent article.

Decades ago, the Law Library at the Library of Congress began publishing surveys describing how other nations addressed certain legislative topics. The impetus for these carefully researched reports was usually a specific request from a Congressional office or committee. Like the CRS and the FRD, the DLR does not typically share the products of its research with the general public. (Note: DLR posts some materials for the use of Congressional staff at a private intranet not accessible to the public.)

A well-connected private company, Pennyhill Press sells copies of 66 DRL reports, abstracts for which can be viewed using this targeted Google search tool. No overall list of DLR reports has ever been produced or released.

The Directorate of Legal Research says it has no comprehensive list of its own publications. The Library of Congress Law Library has certain internal databases not meant for the eyes of the public. But Library staff admits that these do not list all of their reports. Nor are its publications typically added to the Library’s public catalogues. This is for two reasons: internal policies barring public dissemination of these materials, and Congressional guidelines discouraging wider distribution. The congressional committees overseeing these functions are the House Administration Committee and the Joint Committee on the Library.

Over the years, however, certain research reports have migrated into the Library of Congress public library catalogue. There have also, according to Library staff, been intervals during which the Directorate made an attempt to retroactively add numbers of selected reports to the public catalogue. There is no simple way to find the catalogues reports, but by conducting a number of complex catalogue searches, I have identified the titles of some of these DLR publications. Yet only an infinitesimal percentage of DLR studies are actually available to the public. The Law Library produces a large number of reports each year.For example, during 2004, Law Library legal specialists and analysts wrote an impressive 1,947 legal research reports and special studies on the legal aspects of important public policy issues, according to the Library of Congress Annual Report for FY2004, pages 29 and 30. About half of those reports originated in the Directorate of Legal Research, whose staff members wrote 995 research reports, studies, and memoranda for Congressional offices, according to the Report. Of those, 626 reports produced during FY2004 were major, comprehensive research studies. The Library of Congress annual report goes on to say (page 31) that in FY2004, the Law Library also produced 952 research reports to non-congressional constituents, including 236 to executive branch agencies.

It is perhaps ironic that in a political environment where the Supreme Court of the United States and the federal appellate courts have been criticized for the practice of citing foreign law, the Legal Research Directorate is in the business of responding to requests for large quantities of foreign legal scholarship and analysis from the federal judiciary, including the Supreme Court, in addition to Congress and executive branch agencies.

Some reports are produced as ad hoc answers to specific congressional inquiries, others are fleshed out into full reports. Some reports are multinational legal surveys-others are analyses of a single nation’s laws on a particular topic. The criteria for specifying the number of reports produced each year seems to an outside observer somewhat arbitrary. The reports I did find are worth mulling over. Many of the titles are quite intriguing, providing hints at legislative activity in the recent past.

Most of the publications are superb examples of comparative and international law scholarship on subjects of public interest and importance. Because the American common law system is fundamentally predicated on universal access to the documents describing the law, one would think that the research products of the DLR should eventually become accessible. That has not yet occurred, unfortunately, except for those few documents that have already entered the catalogue, and a half dozen sample reports posted on the DLR’s public GLIN website (those have not been included in the listing below).

On occasion, a DLR report or data derived from a DLR report has appeared in print, such as this report on Israeli law. Several other reports can be located by performing a Google Search of the phrase Directorate of Legal Research.

The current trend is not promising. As can be seen from the list of reports below, only a tiny fraction of the many hundreds or thousands of recent have been entered into the Library’s public catalogue; Library staff concedes that there are no current plans to liberalize that process.

Since 1982, the Law Library has also produced the World Law Bulletin, providing a variety of articles on world legal topics. A handful of issues have been posted by the Federation of American Scientists, Secrecy and Government project. But the Law Library has not made available for public use the World Law Bulletin, or its annual indices. Instead, it is kept tightly locked away.

Fortunately, in a welcome change of policy, perhaps assisted by a direct request from the American Association of Law Librarians and the ABA Standing Committee on Law Libraries,
the Global Law Monitor, a new incarnation of the World Law Bulletin is being published on the Library’s internet web site from May 2006 to the present.

The DLR should seek authorization to place more of its valuable scholarship into the Library of Congress’s general catalogues where it can be used by the public. At the same time, the DLR should make available a large proportion of its reports on the Library’s web site, where they can be used by the people who paid for them.

Moreover, critics of the use of foreign law should take into account the substantial use of foreign law information already routed toward the federal appellate courts for use in their deliberative process.

The remainder of this survey contains a list of the DLR reports I found at the Library of Congress and available for public inspection and copying. (The list does not include those reports that can be viewed on the internet, nor other DLR reports sold by Pennyhill Press.)

The list of DLR reports runs mostly in reverse chronological order, but I have altered the order where the DLR has assigned serial numbers to the reports. Certain reports written by DLR for Congressional Committees were published by the Government Printing Office (GPO), and those have been noted accordingly.
